DISCLAIMER

Amyour Advance Healthcare Private Limited ('Amyour', 'Doctordost', 'we', 'our' or 'us') is offering, delivery and facilitation of health and, health related services both via onsite and digital communication (tele-consultation) technologies. Amyour offers tele-consultation remotely and the information is provided on its website (https://www.doctordost.com, https://www.amyourhealthcare.com) and it's mobile application (collectively 'Platform) a property of Amyour Advance Healthcare Private Limited. The tele-consultation (via video, text, call or email) can never be compared to a normal in-hospital consultation, where the doctor is able to physically examine the patient.

Through our platform you are able to link to other websites, which are not under the control of Amyour. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

By using our tele-consultation, you expressly agree to the terms, and give your consent to a tele-consultation with its inherent limitations. While, if the user disagrees, then user should immediately cease all the use and access to our tele-consultation platform.

Every effort is made to ensure comprehensiveness of the consultation, unforeseen situation may arise. However, Amyour takes no responsibility for, complete accuracy of telemedicine consultation, limited in its scope as it is, with no physical examination of the patient being possible.

By agreeing to telemedicine consultation, you acknowledge and accept that the tele-consultations/doctors and any staff members directly or indirectly associated with any aspect of the telemedicine set up shall not be held liable in the unlikely event of a diagnosis or management error caused by the occurrence of sub-optimal technical conditions.

Terms of Use

Amyour Advance Healthcare Private Limited ('Doctordost', "we", "us", or "our") offers an online healthcare service ('service' or 'services') to its registered patients through its web patient portal, available at https://www.doctordost.com, https://www.amyourhealthcare.com and through it's mobile application Doctordost (collectively 'Platform'). Usage of the Platform to access our services are subject to acceptance of the Terms of Use by you. Your use of Platform is subject to services provided by medical practitioners or healthcare providers enrolled on the Platform. Services are managed by these professionals, which will be governed by the Terms of Use.

Through the Platform, we operate and provide various services that would facilitate Patients ('Patient' or 'Patients', 'you' or User') to receive various types of health care and telemedicine services including but not limited to the Patient evaluations, Patient consultations and Patient care, via telephone, messaging or internet-based video ("Telemedicine Services"). The Platform will facilitate the User with a list of medical practitioners, healthcare workers and their profiles and contact details and an option to make online or in person appointment with the respective Practitioner, as desired by the user.

Agreement to Terms of Use ('Agreement')

The Terms of Use create a legally binding Agreement made between you, whether personally or on behalf of an entity and Doctordost, in respect to your access to and use of the Telemedicine Services, or otherwise connected thereto.

The Agreement would be applicable on the entities mentioned as follows:

  1. A professional entity, i.e., medical practitioner or health care provider or similar institution wishing to be listed, or already listed, on the Platform ("Medical Practitioner"); or
  2. A Patient, his/her representatives or affiliates; or
  3. Otherwise, a User of the Platform.

You agree that you are entering into this agreement with one or more of the professional entities, which shall be the providers of professional healthcare services to you, which means, among other things, that you are entering into a Practitioner-Patient relationship with the Medical Practitioner that personally performs the consultation with you. Also, you agree that by accessing the Platform, you have read, understood, and agree to be bound by the Terms of Use. If you do not agree to the Terms of Use, please do not use the Platform and you must immediately cease all use of and access to our services.

Modification and Termination

Doctordost may revise the Terms of Use, from time to time, and make such changes, that would be posted on the Platform. We reserve the right, in our sole discretion, to change, modify, update, add, remove or terminate any portion of Platform, related services, the Terms of Use and the privacy policy without prior notice. Doctordost also reserves the right to change, suspend or discontinue all or part of the Platform, related services, temporarily or permanently, without prior notice. It is entirely your responsibility to review the Terms of Use and the privacy policy when you use the Platform.  Your frequent use of the Platform, following any changes to the Terms of Use and privacy policy, will mean you accept these changes. If you disagree with the updated Terms of Use and privacy policy, you should not access and must stop using the Platform immediately.

Emergency

The Telemedicine Services are not intended to be a substitute for getting in touch with emergency healthcare. In case of medical emergency (either on your or another person's behalf), always contact your own healthcare provider and go to the nearest hospital or healthcare provider.

Consultation

Each proposed consultation by Doctordost will be assessed on a case-to-case basis. Doctordost health care services may not be able to fulfil your needs through video/text/telephonic consultation due to complex medical problems and it may further require attending a face-to-face visit with your Medical Practitioner or attending a further Doctordost consultation. You may have the discretion to cease our consultation at any time. It cannot be guaranteed by us that you can be diagnosed, provided with any necessary medical advice, or any treatment plan finalised during a consultation.

Mode of consultation

Doctordost allows Medical Practitioners to evaluate, diagnose and treat Patients using telecommunications technology which include any of the following electronic communications such as, but not restricted to, telephone calls, messages/ chat platforms, video calls using devices connected over LAN, WAN, Internet, mobile or landline through Platform or internet based digital platforms or data transmission service providers or e-mail, whichever is suitable for carrying out the Patient consultation. Doctordost also allows the Patient to book a consultation request with any of the specialty Medical Practitioner listed on the Platform. The consultation may comprise of any of the following:

  1. Online video Consultations,
  2. Online Text, Voice or Question Based Consultations or
  3. Scheduling an In-person visit.

However, consultation with Medical Practitioners shall be confirmed subject to their availability. Also, the Medical Practitioner waiting time is only estimated and long consultation/procedures/emergencies can affect waiting time. Also, the Medical Practitioner has full and unequivocal discretion, for any reason they consider reasonable, to:

  • interrupt or re-schedule;
  • discontinue; or
  • decline to provide consultation to you.
Text or Question based consultation

While a live video or voice session will generate an immediate and obvious response from the healthcare provider, response time for a question posted on the Platform can vary according to the availability of the healthcare provider and no guarantee can be made in this regard. Every attempt will be made to provide responses to your questions within the stipulated response time. However, do not, under any circumstances, delay seeking direct medical attention from your healthcare provider or nearest hospital in case of an emergency. Asking medical questions to a healthcare provider, whom you have not been consulting directly, does not necessarily result in establishing a doctor-patient relationship. Any advice or information in responses to your questions/text consultations to healthcare providers of Doctordost, do not qualify as a medical prescription, diagnosis or treatment plan.

Video Consultations
  • Video Consultation Appointment Timing: While the patient may specify the preferred appointment timing for a Video Consultation, Doctordost reserves the right to schedule the appointment for an alternative timing. If this timing is not convenient, the user can request that it be rescheduled. Due to unpredictable medical emergencies, it may be that the healthcare provider is sometimes unable to attend to the video consultation exactly at the appointed time. In such cases the session might be rescheduled to a later time in consultation with the patient.
  • Video Consultation Duration: By default, the average duration of a Video Consultation will be the duration decided by the healthcare provider. Doctordost reserves the right to decide when the consultation ends. This could be earlier than the maximum possible duration. If the healthcare provider has to conclude the video consultation mid-way due to a medical emergency, then a new session at an alternative timing will be scheduled.
  • Video Session Quality: The quality of the video session depends on the quality of the Internet connection, web cam and audio facilities of both the patient and healthcare provider. It is the responsibility of the patient to ensure that the performance and quality of the equipment and connection used, are optimal for doing video calls online. Video Consultations that fail on account of poor equipment and connectivity will not be rescheduled for free. Nor will there be any refund of payment.
  • Video Session Privacy, Security & Etiquette: It is required that the patient prepares ahead of time to participate in the Video Consultation, in a quiet and private place, where only the patient is present in the room where the video session is being held. For elderly or disabled patients who require help to participate in the video, a caregiver may be present. There must be no audio/video recording of the video session by the patient. It is necessary that the patient (and any caregiver) act with proper decorum in speech and action during the video consultation. Failure to comply with these requirements can result in termination of the video session with no refund or rescheduling of the consultation.
  • Nature of Consultation: Video Consultations must not be scheduled for patients with critical medical conditions and/or for emergencies. Such consultations are suitable only for basic follow-ups between the patient and healthcare provider and/or preliminary consultation before meeting the healthcare provider in person.
Remote Monitoring Services

Our Remote Monitoring packages are only for communicating specific health parameters to the healthcare providers on Platform and will not substitute actual clinical visits. You are required to visit the healthcare provider as and when specified by your doctor or whenever you need healthcare.

  • If the monitoring feedback provided by the healthcare provider is substantially different from your current treatment and prescribed medication, it is your duty to confirm the same before implementing the advice.
  • The health information, vital sign readings, dates, timings and notes logged in by you or on your behalf should be accurate.
  • As a Patient of Doctordost, you are required to inform your healthcare provider of all current and previous illnesses, health conditions, surgeries, consultations and medications with any other healthcare providers. While our healthcare team may help to update your Personal Health Record ('PHR') based on information provided by you/your representative, it is your responsibility to update all aspects of the PHR completely and correctly.
  • For efficient monitoring and proper healthcare services, the Patient is required to enter all vital health data through the Platform as per the schedule and level of detail advised by the doctor.
  • For self-monitored readings, it is the Patient's responsibility to use devices of proper quality and to ensure that they are re-calibrated when required.
  • Not following the instructions of the healthcare team will be considered as non-compliance of the Agreement and the Agreement will be terminated.
  • The healthcare team will provide instructions based on the vitals entered by you. You are advised to enter the vitals accurately.
  • Doctordost will not assume any legal responsibility for the Patient's medical condition and this online consultation only intends to aid in understanding the condition better based on the information given and is not meant to replace an in-person consultation.
  • The online system is expected to enhance, not replace clinic visits. It is your responsibility to schedule follow-up appointments as indicated by your doctor.
  • The Patient is free to discontinue, using a remote monitoring plan, at any time, with the knowledge of your consulting healthcare provider.
  • The healthcare provider does not attend to emergencies through the Platform. Under these circumstances, Patient has to contact the nearest hospital immediately.
  • Doctordost may provide one or more remote monitoring plans. When signing up for or after being assigned to any such remote monitoring package, it is the duty of the Patient to understand the instructions and terms of that package and to fulfil them.
  • The Patient data will be available for review to the healthcare provider and Doctordost quality monitoring team. The Patient data will be kept confidential by Doctordost and will not be disclosed to anyone under normal circumstances except as requested by law or in an emergency situation where the Patient is not in a condition to provide consent to such disclosure.
Age limit

You must be eighteen (18) years of age or older to register, access or use the Platform. By registering, visiting and using the Platform or accepting this Agreement, you represent, acknowledge and affirm that you are 18 years of age or older, and that you have the right, authority and capacity to use the Platform and agree to the Agreement. For a minor under 18 years of age, it is necessary that the parent or legal guardian agrees to the Terms of Use before using the platform on behalf of the minor.

Prohibited conduct

You hereby agree, without limiting the foregoing, not to:

  1. Systematically retrieve data or other content from the Platform to use it, directly or indirectly without written permission from Doctordost.
  2. Attempt to access or use, the Platform to take any action that could harm us or any third-party, interfere with the operation of the Telemedicine Service, or use these services in a manner that violates any applicable laws or regulations or the Terms of Use;
  3. Misrepresent or impersonate your identity or affiliation in any way with any person or entity;
  4. Access and use any device, software, or any means to interfere or attempt to interfere and causing unnecessary obstacles with the proper functioning of the Platform or attempt to probe, scan, test the vulnerability of, or breach the security of any associated system or network;
  5. Interfere with, disrupt, or take any action that would impose an undue burden on the Platform or the networks or services connected to it.
  6. Circumvent, reverse engineer, decipher, decompile, disassemble, decrypt, or otherwise alter or interfere with (or attempt, encourage, or support anyone else's attempt to engage in such activities) any of the software comprising or in any way making up a part of our services. The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools or network probing tools) is strictly prohibited;
  7. Obtain or attempt to gain unauthorized access to any User accounts or other computer systems, networks, materials and contents, information or any service available on or through the Telemedicine Service through hacking, password mining or any other means;
  8. Engage in unauthorized use of robots/bots, spiders, scraping, harvesting of content or information or use any other unauthorized automated means to compile information or to access our services for any purpose;
  9. Attempt to disrupt the operation of the Telemedicine Service by any method or upload or otherwise transmit any communication, software or any material that would expose us to any viruses, worm, spamming/phishing or flooding, denial of service, spyware or any other computer code, file or program that may or is intended to damage or hijack the operation of any hardware, software or telecommunications equipment;
  10. Engage in any other conduct that restricts or inhibits any person from using our services, or that, in our sole judgement, exposes us or any of our Users, affiliates, or any other third-party to any liability, damages, or detriment of any type;
  11. Post, use, store, send or otherwise transmit:
    • a message or information under a false name;
    • information that is unlawful, infringing, libellous, predatory to minors, harmful, harassing, obscene, defamatory, threatening, hateful, fraudulent or otherwise objectionable material of any kind, any material that can cause harm or delay to the Platform or computers of any kind, and any unsolicited advertising, solicitation or promotional materials;
    • information that infringes or violates any of the intellectual property rights of others or the privacy or publicity rights of others.
  12. Use the Platform in any manner that could disparage, tarnish, damage, disable or impair the reputation of Doctordost and its services;
  13. Access or use the Platform in an unlawful way or for an unlawful or illegitimate purpose or in any manner that contravenes these terms;
  14. Alter or modify any part of the content or services offered on or through the Platform;
  15. As a user you may not use automated tools on our applications without our consent, nor cause any degradation of our application services. You may not compromise the privacy and security of any user data, nor cause its modification, misuse or destruction in any way.
  16. As a user, you will not use malware or engage in phishing activities to compromise the security of our applications and services
  17. Violate any applicable laws or regulations or the Terms of Use;
  18. Assist or permit any persons in engaging in any of the activities described above.
Privacy Policy, Handling of Personal Information and Personal Health Information

This Privacy Statement governs the online information collection practices of Amyour Advance Healthcare Private Limited ("doctordost", "Company", "we", "us" or "our").. It outlines the types of information that we gather about you while you are using our websites https://www.doctordost.com or https://www.amyourhealthcare.com (the "Sites") and the ways in which we use this information.

PURPOSE AND SCOPE

The Privacy Statement applies primarily to information that we collect online; however, it may apply to some of the data that you provide to us offline and/or through other means, as well (for example, via telephone, or through the mail) The Privacy Statement documents and describes the manner in which our organisation collects information from all our Users/ Viewers of our Services. While providing our Services on behalf of our registered users, we collect information related to Viewers. The use of information collected on behalf of our Users is governed primarily by our contract for the engagement with them and the privacy policies governing their organization. We are not accountable for the privacy policies and practices undertaken by our users or any other third parties.

TRACKING TECHNOLOGIES AND COOKIES

Cookies are used to save user preferences, preserve session settings, help autoauthentication of frequently used services if required by your settings and to enable other similar functional requirements. You may use browser settings to disable cookies when using our web services, however it may result in some of the features and services of this application not functioning properly. The only third-party cookies used by the application are AWS (Amazon Web Services) load balancer cookies required for functioning of this cloud based application. These cookies have a one week expiry. The first party cookies used by this application are for security and authentication purposes only. One of these cookies has a session lifespan and the other has a one year lifespan

THE TYPES OF INFORMATION WE COLLECT AND STORE

We may collect personal and sensitive personal information about you and store this information in connection with the provision and fulfilment of our services to you. Personal Information may include but is not limited to:

  • Email Address,
  • First Name and Last Name, Gender, Date of Birth
  • Phone Number,
  • Address, State, Province, ZIP/Postal code, City
  • Any image you upload to use as profile picture (should you choose to add it to your user account)
HOW WE USE YOUR PERSONAL INFORMATION

The above personal information may be used for the following purposes but shall not be limited to the them.

  • To provide you with information about our offerings and/or our periodic newsletters;
  • To respond to your requests;
  • For creation or development of business intelligence or data analytics in relation to the Offerings provided by us (for this purpose we may share the Personal Information with certain software or tools available online);
  • To manage our relationship with you;
  • For internal record keeping;
  • To provide you with authorization to login and use your user account;
  • To verify your identity;
  • To maintain correct and up-to-date information about you;
  • To identify you as a contracting party;
  • To improve our website;
  • To enable automated handling of the subscriptions;

WHO HAS ACCESS TO YOUR DATA WITHIN OUR ORGANIZATION?

Within our organization, access to your data is limited to those persons who require access in order to provide you with the Products and Services, which you purchase from us, to contact you, and to respond to your inquiries, including requests for refund. Those staff members may be on teams such as: marketing, events, development, executive, customer support. WHO DO WE SHARE YOUR DATA WITH OUTSIDE OUR ORGANIZATION AND WHY?

Processors We may use service providers and third parties for operating and improving the Sites, to assist with certain functions, such as payment processing, email transmission, conducting surveys or contests, data hosting, managing our ads, third-party solutions for marketing and analytics, and some aspects of our technical and customer support.

Authorities

We may access, preserve, and disclose information about you to third parties, including the content of messages if we believe disclosure is in accordance with or required by, applicable law, regulation, legal process, or audits. We may also disclose information about you if we believe that your actions are inconsistent with our Terms and Conditions or related guidelines and policies, or if necessary to protect the rights, property, or safety of, or prevent fraud or abuse of, Company or others.

WHY AND FOR HOW LONG DO WE STORE INFORMATION WE COLLECT FROM YOU?

We retain certain information collected from you while you are a member on the Site, and in certain cases where you have deleted your account, for the following reasons:

  • So that you can use our Sites;
  • To ensure that we do not communicate with you if you have asked us not to;
  • To provide you with a refund, if entitled;
  • To better understand the traffic to our Sites so that we can provide all members with the best possible experience;

PERSONAL HEALTH INFORMATION

As per these terms and conditions, "personal information" means any information that is required to identify an individual, for example your name, mailing address, gender, date of birth, e- mail ID, or any other data that you mention to provide through sites and platforms and any other information that will assist in identification of a person. "Personal Health Information" means the information that patient users themselves or authorized employees of Doctordost enter into the Personal Health Record of a patient, including age, gender, known health conditions, medications, allergies, vaccinations, history of surgeries or procedures, goals, health journal entries and data that you enter into your health trackers either manually or by syncing with a health monitoring device or from a third party source that you alone authorize. It also includes medical reports and files that you choose to upload into your health profile.

  • By using the Platform, you hereby consent that your personal information and personal health information is bound by our privacy policy, which is incorporated into these Terms of Use.
  • The accuracy, integrity and completeness of the personal health information you enter, directly sync from health sensor devices and/or sync from your other health or fitness accounts into your health record, is your responsibility, and Doctordost assumes no liability for it.
  • Syncing of data from your health or fitness accounts from external third party systems including but not limited to Google Fit and Apple Health app, requires you to authorize access to sync data into your health record. It also includes medical reports and files that you choose to upload into your health profile.
  • If at any point of time, we find that the information provided by you is false/deceptive/inaccurate or misleading, Doctordost reserves the right to cancel your appointment without assuming any liability whatsoever. Hence, it's advised to submit/upload all relevant and accurate information.
  • While we strive to protect your personal information and personal health information, you should be aware of possible risk involved in transmitting information over the Internet as no data transmission can be guaranteed to be 100% secure and of risk that others could find a way to thwart our security systems. As a result, we cannot ensure or warrant the security and privacy of l information you transmit to us, and you do so at your own risk.
  • All data is stored only on HIPAA and GDPR compliant cloud infrastructure on Amazon Web services. All data transmission and storage are AES encrypted. No data is stored on your mobile devices. The cloud infrastructure is protected by a secure firewall.
  • The application stores data, including personal health data, communications, usage data including but not limited to location, device type, operating system, browser, date-time and context usage, in HIPAA and GDPR compliant cloud infrastructure. All data storage and transmissions are encrypted.
  • Any files that you upload into your personal health record in the app, including your profile picture, medical reports and any other file attachments are all securely uploaded and stored in your personal health record in our secure clouds storage
  • Operations Data: In order to enhance your usage experience and to ensure secure audit mechanisms, the application uses cookies, server logs and other similar mechanisms to enable certain functionality, improve services and monitor service usage. The log data includes context usage, location, device type, operating system, browser, date and time.
  • The software technology services are provided and maintained by NeedStreet Web Technologies Pvt Ltd, Padmanabham, Technopark Trivandrum, Kerala, India. Usage of this application does not make the technology vendor supporting this application, liable for any of the healthcare and/or other services you use through the application, nor does it result in any implied obligation between you and the vendor.
  • Data in your personal health records will be accessible to and modifiable by authorised employees and healthcare providers of Doctordost, solely for the purpose of providing you with healthcare services.
  • Non- personalised system analysis of non-identifiable patient data may be done to enable better healthcare outcomes for the patients of Doctordost. However, the identity of individual users will remain completely anonymous in such analysis.
  • We may disclose any information to government or law enforcement officials;
    1. If we believe doing so is required to comply with mandates of law and legal process;
    2. To prevent or stop any illegal, unethical, or legally actionable activity;
    3. To protect your, our or others right and safety.
  • We may disclose your personal information on your own request accompanied by your permission. Doctordost does however reserve the right to deactivate or delete accounts of any User found to be in violation of our Terms of Use. Doctordost may retain your information:
    1. Till the time it deems necessary;
    2. Till the time it deems necessary to meet its legal obligations, resolve disputes, and/or enforce agreements; or
    3. Till it is needed to facilitate you with relevant services.
  • Doctordost may dispose of or delete any such information at any time, except as set forth in any other agreement or document executed by Doctordost or as required by law.
  • You have the right to request deletion of your user account with Doctordost. Your account and all data in it will then be completely deleted. We reserve the right to maintain billing data only for our financial records.In the event of any breach of your personal health data, you will be notified.
LINKS TO OTHER WEBSITES

Our Sites may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party ' s site. We strongly advise you to review the Privacy Policy of every site you visit. Third parties are under no obligation to comply with this Privacy Statement with respect to Personal Data that you provide directly to those third parties or that those third parties collect for themselves. We do not control the third-party sites that may be accessible through our Services. Thus, this Privacy Statement does not apply to information you provide to third-party sites or gathered by the third parties that operate them.

OUR POLICY CONCERNING CHILDREN and THEIR DATA

Our Sites are not meant to be used by minors under the age of eighteen and we do not knowingly collect personally identifiable information from children. For health consultation of a minor under 18 years of age, it is necessary that the parent or legal guardian agrees to the Terms of Use before using the platform and entering information on behalf of the minor.

TRANSFER OF BUSINESS

If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information could be one of the assets transferred to or acquired by a third party.

We may update our Privacy Statement from time to time. You can see when the Statement was last updated by checking the date at the bottom of this page. You are advised to review this Privacy Statement periodically for any changes. Changes to this Privacy Statement are effective from when they are posted on this page.

Payments, refund and cancellation policy

This is payment, refund and cancellation policy of Amyour Advance Healthcare Private Limited (''Doctordost', 'we', 'us', or 'our'). Our aim is to provide complete satisfaction to our users and in eligible cases, we will refund the full amount paid by you for the consultation if it is genuine and gets proved after a quick investigation from our end. Please read the terms of this policy carefully.

Payment, fees and taxes
  • Registration on the website and app is free, Amyour does not charge you any fee for browsing and registration. Amyour can collect the payments on behalf of third-party service providers, including taxes and fee (wherever applicable) according to the Reserve Bank of India rules and guidelines, through authorized gateway. You agree and acknowledge that Amyour will not be liable for any loss or damage caused to you during the collection of the fee on the behalf of the third party. All fees displayed in our Platform (https://www.doctordost.com and Doctordost's mobile application) are including all types of taxes. In order to receive the payment, Amyour may collect personal financial information and other necessary details for processing of payments. Please go through our privacy policy to know how Amyour uses this information and up to what limit it is been used.
  • All consultation fees for services through the mobile and web application interfaces of Doctordost have to be paid as per the terms of the service that you use. Offline payment collection for some of these services is supported too.
  • In course of time, Doctordost may introduce other services in the system, the charges for which will be communicated to you as and when such services are introduced.
  • The healthcare provider reserves the right to revise the consultation and service charges at any time, at the sole discretion of the healthcare provider. The charge applicable at any given time, will be the charge displayed at the time of using the service.
  • Payments made for any remote monitoring plans will not be refunded should you decide to discontinue.
Cancellation and Refund Policy
  • You may request to change or cancel a booking for Doctordost consultation through the Platform. However, changes in the booking will be subject to the concerned Medical Practitioner's or the healthcare worker's availability. Also, the User or Patient will only receive the refund of the payment made for the booking if they cancel the booking at least twenty-four hours prior to the time of the scheduled appointment time. If the situation arises wherein the User or Patient has booked a paid appointment with the concerned Medical Practitioner and due to any reason, the Practitioner is unable to attend the User on the said date of appointment, the user will have the option of rescheduling the appointment, through our web portal and app. A helpline number will also be available on the web portal to reschedule your appointment. Please note that healthcare professionals may be busy in emergencies and may not be able to keep up with the exact timing of appointment. If the User or Patient still cannot get an appointment within the said date of confirmed appointment and doesn't want to reschedule for later, then he/she will need to contact us within seven (7) days from the occurrence of such event. Subsequently, the consultation amount will be refunded to the User within forty-two (42) business days in the original mode of payment selected by the User while booking the consultation. For refund of any services booked through a third party, please contact the third party directly.
  • If the User or Patient doesn't cancel and not appear for the appointment booked with the concerned Medical Practitioner, the amount will not be refunded to the User or Patient. Also, the User or Patient will not be entitled for any refunds of Platform service fee if in case the User or Patient is required to wait or refuse to obtain the health professional's service due to the fact that the concerned professional is occupied for some reason and is unable to attend the User or Patient at the exact scheduled time for the appointment.

Review/ Feedback Rights

Doctordost truly welcomes your feedback and reviews on our Platform. However, any feedback, suggestion or reviews you may provide will not be treated as confidential by us. Also, you acknowledge that Doctordost may use your feedback and reviews without any obligation for any purpose, commercial or otherwise, worldwide. You grant us a non-exclusive, irrevocable, perpetual, royalty-free, freely transferable license to use, practice, distribute, publish, edit, exploit, modify and sub-license such feedback and reviews as Doctordost may deem appropriate as per its sole discretion.

Limitation of Liability

Under no circumstances, shall Doctordost, or any of its officers, employees, directors, agents or content or service providers, shall be liable to you or any third party for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising out of or in connection to, the access or use of, or the inability to access or use the content and materials provided on Platform, User's information via the website, lost business and so on even if such professional entities have been advised of the possibility of such damages. Also, Doctordost or any of its third party shall not be held liable for any punitive, exemplary, consequential, incidental, indirect or special damages (Including but not limited to any personal injury, lost profits, business interruption, loss of data or otherwise) related to the use of the Telemedicine Service, whether in respect to breach of Agreement, negligence, strict liability, malpractice, or otherwise even if we have been advised of the possibility of such damages. Furthermore, the service providers, listed on the Platform, shall not be held liable for any loss or damages due to any errors or omissions in any content, any infringement by any content of the intellectual property rights or other rights of third parties incurred as a result of the use of the content on the Platform. Our third parties shall not be liable for:

  1. Failure in providing all or any service by medical practitioners to the Patients contacted or engaged through the Platform;
  2. Any content posted, transmitted, exchanged or received by or on behalf of any User or other person on or through the Platform;
  3. Any unauthorized access to or alteration of your transmissions or data; or
  4. Any other matter relating to the Platform.

You expressly agree that: If you are dissatisfied with the services on Platform or any of its content, you unequivocally agree that your sole and exclusive remedy is to cease using the Platform and its services.

  • You acknowledge that by using the Platform, your access to and use of the Platform is entirely at your own risk and is subject to the terms mentioned herein and the applicable laws of the specified jurisdiction(s).
  • However, if any part of this limitation of liability is found to be invalid or unenforceable for any reason that is reasonable, in no event shall the total aggregate liability of our third-party professional entities to a User for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from the Agreement or a User's use of the Platform exceed, in the aggregate Rupees One Thousand Only (INR 1000/-).
Indemnification

By using the Platform, you agree to indemnify, defend and hold harmless Doctordost, our affiliates and all of our respective officers, directors, medical practitioners, agents, employees, representatives, contractors, and information and service providers ("Indemnified Parties") for any losses, claim, demand, damages, costs including court costs, and/or expenses including attorney's fees and accounting fees, that arise out of your use of the Platform, your use of the content provided on the Platform, breaching Terms of Use by you or any other person using your User account, or your violation of the rights of a third party, including but not limited to intellectual property rights, your violation of conduct during the consultation or your communications to third parties during the consultation. We reserve the right, at your expense, to assume the exclusive defence or necessary participation and control of any matter for which you are required to indemnify us and you agree to cooperate, at your expense, with our defence of such claims.

Dispute resolution

Doctordost will try its best to resolve any issue you have in relation of usage of Platform. However, Doctordost is aware of the fact that there may be rare cases where we may not be able to resolve an issue to your satisfaction. In the event a dispute is unable to resolve between you and Doctordost, you agree that the Agreement and any contractual obligation related to any use or access of the Platform will be governed by the laws of India, without regard to applicable principles of conflicts of law.

  • Any claim or dispute arising out of or in relation to the Agreement, including but not limited to the determination of the scope or applicability of the Agreement to arbitrate, or your access or use of the Platform or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by Doctordost. Arbitration shall be conducted conforming to the Arbitration and Conciliation Act, 1996.
  • The seat of such arbitration shall be Lucknow, Uttar Pradesh. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.
  • The courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction over any disputes arising out of or in relation to the Agreement, your access or use of the Platform or the information to which it gives access.
Release of Force Majeure

While Doctordost make every possible attempt to meet and fulfil the needs of the Patients, such unforeseen situations might occur that are beyond their reasonable control. In such situations, Doctordost will not be held liable for any failure or delay in performing any obligations where it results from any event that is beyond their reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action by third parties, civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism, acts of war, governmental action, epidemic or other natural disaster, or any other event that is beyond their reasonable control.

Availability and accuracy of information

We do not assure you that the Doctordost service will always be accurate or defect free due to any reasonable grounds. We do not promise the Users or Patients anything in relation to the timeliness, accuracy, suitability, quality, speed or completeness of any information, content, or services available via Doctordost, or that the information collected, displayed or communicated by Doctordost is always accurate or complete. Doctordost is not liable for any periods of non-availability of this application or platform due to any reason. Under such circumstances you are adviced to directly contact Doctordost for any services you may need.

Security viruses and errors

As the internet is an insecure public network and is prone to risks. Thus, the information sent to or from Doctordost may be intercepted, corrupted or modified by third parties. In addition, files obtained from or through Doctordost may contain computer viruses, disabling codes, worms or other devices or defects. You bear the risks and responsibility for any loss or damage caused, directly or indirectly, by these risks, and Doctordost accepts no liability for any interference with, or damage to, your computer system, device, software or data occurring in connection with Doctordost.

Choice of law

These terms shall be governed in accordance with laws of India. The parties irrevocably submit to the exclusive jurisdiction of courts in Lucknow, Uttar Pradesh in respect of all matters and disputes arising hereunder, and waive any defence of lack of personal jurisdiction in that jurisdiction. If any provision of the Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Agreement, which shall remain in full force and effect.

No endorsement

In respect to any service, consultation, recording, event, process, publication, or offering of any third party by name, trade name, trademark, service mark, company name or otherwise does not constitute or imply the endorsement or recommendation of such by Doctordost. Any views expressed by third parties on the Platform are solely the views of such third party and Doctordost assumes no responsibility for the accuracy or veracity of any statement made by such third party.

Representation and Warranties

By using the Platform, you represent and warrant that:

  1. You have a lawful authority to enter into the Agreement;
  2. The information that you have provided in your registration will be true, accurate, current, and complete;
  3. You will maintain the accuracy of such information and promptly update such registration information as necessary;
  4. You have the legal capacity and you intend to comply with these terms.
  5. You are not under the age of 18;
  6. You are not a minor in the jurisdiction in which you reside or if a minor, your parent/ guardian has agreed to the terms and condition to use the Platform on your behalf;
  7. You will not access the Platform through automated or non-human means, whether through a bot, script, or otherwise;
  8. You will not use the Platform for any illegal or unauthorized purpose;
  9. You will not interfere with a third party's use and enjoyment of the websites and Platforms;
  10. You will comply with any and all laws applicable to your use of the Platform.

If you provide any information to Doctordost that is false, inaccurate, not current, incomplete or otherwise misleading, you will immediately notify us. If you fail to do so, then we have the right to suspend or terminate your account and refuse any and all current or future use of the Platform (or any portion thereof).

Access to the Platform

Doctordost grants you a limited, revocable, non-exclusive, non-transferable license to use the Platform in accordance with the Terms of Use. In order to use the Platform:

  1. You will be asked to register an account and create login information, including, username and passwords.
  2. You must safeguard your login information and you must not disclose this information with any third party. You must immediately notify Doctordost of any unauthorized use of your account or of any other breach of security that you become aware of involving and relating to the Platform.
  3. You also agree that you will be solely responsible for any activities conducted on or through the Platform with your account regardless of whether or not you are the individual who undertakes such activities. This includes any unauthorised access and/or use of your account or your device. You hereby release and hold harmless Doctordost from any and all claims and causes of action arising out of or resulting from a third party's unauthorised use of your account.
  4. Family User accounts added under you User account should strictly be added only for minors and dependents in your family who cannot operate their own independent User account and who have consented (if able) to you doing so on their behalf. You will receive all notifications related to your family account members and will be able to access their accounts. Only a maximum of six (6) family User accounts can be included under your account. By setting up a family User account under your account for a dependent adult family member, you agree that you have done so with valid consent of such family member(s).
  5. As a User of services through the Platform, you agree to receive essential service-related notifications in the form of SMS, email or mobile notifications. Notification settings to turn off non-essential notification are available.
Third party websites, content and services

The Platform may contain links to the website of third parties and content belonging to or originating from third parties. Doctordost will not be held responsible for any third-party websites accessed through the Platform or any third-party content available or posted on the concerned site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the third-party websites or the third-party content. Inclusion of any link on the Platform does not imply that Doctordost approves or endorses the linked site. User may use the links and these services at User's own risk. You agree and acknowledge that you shall hold us harmless from any harm or losses sustained by you or harm caused to you relating to or resulting in any way from any third-party content or by any contact with third-party websites.

Copyright, trademarks and Intellectual Property

All content and information provided on the Platform including, but not limited to, text, photographs, video, documents, graphics, visual designs, button icons, branding, images, artwork, names, logos, trademarks, service marks, and other data, in any form are proprietary to Doctordost and is owned or licensed to us. All the content and materials provided on the Platform is protected by trademarks, copyright, patents, proprietary rights and all applicable intellectual property law in India.

You are authorized only to access and view the content available on Platform and may use the content for personal use are not authorized to reproduce, sell, or exploit the Platform or content of the Platform for commercial purposes. However, you are not authorised to modify, obscure, remove, publish, transmit, distribute, participate in the transfer or sale, create derivative works, or in any way exploit for commercial gain, any portion of the Platform or the content available on the without the prior written permission of the owner of the material. All rights not expressly granted herein are reserved to Doctordost.
